General Terms and Conditions

GastroMarket – Linorex s. r. o.

These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the business relationship between GastroMarket – Linorex s. r. o., with its registered office at Štefana Králika 7, 841 08 Bratislava, Company ID: 00604127, registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro/296/B, as the Seller (hereinafter referred to as the “Seller”), and its business partners – Buyers (hereinafter referred to as the “Buyer”).

All deliveries of goods and services made by the Seller are governed by these GTC unless the contracting parties agree otherwise in writing.

1. Orders

  • The Seller accepts only orders made in written form (delivered in person, by mail, e-mail, or fax).
  • An order must contain at least:
    • the Buyer’s billing information,
    • the catalog number, name, and quantity of the goods,
    • the delivery date, address, and method of delivery.
  • If the Buyer does not specify the method of transportation, the Seller is entitled to determine the most suitable delivery method.
  • The Seller shall confirm the received order no later than within 2 working days after its receipt.
  • The goods are reserved for a maximum of 21 days; after this period, they may be allocated to another customer.
  • Any change to an order must be approved by both parties.

2. Payment Terms

  • The invoice is issued at prices valid on the day of invoicing.
  • For goods in stock, payment in cash upon collection or advance payment to the Seller’s account is required.
  • For goods ordered at the Buyer’s request, a deposit of 30% of the total price is required as confirmation of the binding order.
  • The remaining balance is payable upon receipt of goods or in advance to the Seller’s account.
  • Ownership of the goods remains with the Seller until full payment of the purchase price (retention of title under § 445 of the Commercial Code).

3. Delivery Terms

  • Goods may be collected in person from the Seller’s warehouse or delivered by a contractual carrier at the Buyer’s expense.
  • The delivery date is always individual and agreed upon between the Seller and the Buyer.
  • The Seller shall not be held liable for delivery delays caused by circumstances excluding liability (so-called force majeure – § 374 of the Commercial Code).

4. Warranty and Claims Conditions

  • The Seller provides a 12-month warranty on the functionality of the goods from the date of acceptance.For selected products (e.g., Berto’s, Alphatech), an extended warranty for spare parts is provided.
  • In such cases, parts are supplied free of charge, but the Buyer covers transport, installation, and service costs after the initial warranty period. 

4.1 Warranty Repairs

  • Installation and assembly may only be carried out by an authorized service technician of the Seller or another qualified professional.
  • The Buyer must provide proof of professional installation. Warranty service is provided at the Seller’s premises or at an authorized regional partner’s location.
  • Service intervention at the Buyer’s premises is only available for equipment requiring professional installation; otherwise, the Buyer must deliver the goods to the service center at their own expense.
  • Post-warranty service is provided under individually agreed terms.

4.2 Warranty Recognition Conditions

  • The Buyer must present a properly completed warranty card issued by the Seller upon receipt of goods. If no warranty card was issued, the invoice serves as proof of purchase.
  • When submitting a claim, the Buyer must provide the invoice number and make the equipment available for diagnosis and repair at the service center.

4.3 Warranty Limitations

The warranty does not apply in particular to:

  • defects caused by incorrect installation or intervention by unauthorized personnel,
  • damage resulting from neglect of regular maintenance or improper use,
  • defects caused by improper product selection, excessive wear, or use contrary to the operating manual,
  • transport damage occurring after collection by the Buyer or their carrier,
  • normal wear and tear (e.g., seals, hoses, bulbs, plastic parts, etc.).
